Two Bills and a Court Ruling Pending in Texas

Texas is among other states that will be considering sodomy repeal measures this year, one introduced by Representative Debra Danburg (D-Houston) and one by openly gay Representative Glen Maxey (D-Austin), HB 389. Danburg expects the bill to make it out of the now-majority-Democrat House criminal jurisprudence committee where it failed last year.

But the Republican Party of Texas’ platform included a public rebuke for two Republican judges on a three-judge state appellate panel who found the law unconstitutional; the full bench of the 14th Court of Appeals will be reviewing their decision, after which an appeal to the Texas Court of Criminal Appeals is expected.
